SEC announces action against a regional center marketer for illegally offering and selling securities to EB-5 visa investors just a day after we said that regional centers illegally offer and sell securities.

Joe Whalen was wrong in claiming that ICE SSA Taylor John had no reason to investigate fraud in the EB-5 visa program.

Can Joe Whalen ever be trusted or taken seriously again?

Joe Whalen asked rhetorically: What is the motivation for an ICE Agent to do anything about EB-5?

First and foremost, Joe Whalen (who makes his living by advising regional centers) is wrong in stating "ICE is not under any mandate to “investigate” any aspect of any USCIS Program without an invitation and then it would be targeted at specified aliens for immigration- related offenses."

If he looks at the mandate of ICE - HSI by visiting the website http://www.ice.gov/identity-benefit-fraud, he will realize that ICE - HSI doesn't need any invitation to investigate benefits fraud.

He wrongly claims, "Under no conceivable circumstances would an ICE Special Agent be tasked with investigating a visa program run by USCIS; DHS Officials; or any political figures such as U.S. Senators."  Mr. Whalen is wrong, as SSA Johnson was investigating BENEFITS fraud that happened to have been orchestrated by Democrat politicians at the behest of a crooked senior DHS official Mayorkas (who was already reviled for his corruption in getting a presidential pardon for a drug dealer caught with about 400 kilos of cocaine).

As a matter of fact, ICE - HSI HAS been known to investigate and prosecute visa programs run by USCIS. A clear example can be found by searching online for "ICE Vision Systems Group H1B fraud", where ICE agents arrested Viswa Mandalapu and Chandra Mandalapu for fraud or even at this link https://www.ice.gov/news/releases/indian-national-pleads-guilty-false-work-visa-scheme

Mr. Whalen is right in saying that USCIS has its own investigative arm in the Fraud Detection and National Security Directorate (FDNS) which actually has a dedicated EB-5 unit embedded at the Immigrant Investor Program Office (IPO), but conveniently fails to mention that FDNS was NOT embedded with USCIS IPO when SSA Johnson started investigating the case.

He is WRONG when he claimed "If any domestic EB-5 players needed investigation then the FBI would be contacted as it has been already.", as USCIS is required to inform ICE - HSI when they encounter large scale benefits fraud.

He is absolutely wrong when he wrongly claims "Where it is appropriate, USCIS has also called upon the SEC and FINCEN. Abroad, USCIS also might call upon FDNS but is more likely to contact the State Department for additional help than anyone else. Once in a while USCIS might reach out to ICE, especially HSI. Lastly, where multiple national borders might be crossed, INTERPOL can be approached for assistance. You can “whistle-blow” it out your ***! Your 15 minutes are up!"

When USCIS encounters large scale or organized visa fraud, then ICE - HSI is the first agency they're required to contact as per the law. See link http://www.ice.gov/hsi

Mr. Whalen doesn't even mention the fact that Alejandro Mayorkas violated USCIS protocols to fraudulently obtain EB-5 visas for his political masters (the Clintons and Senator Reid who violated Senate rules to get him appointed), and the fact that the EB-5 visas were fraudulently obtained can be easily verified by simply having the source of funds documents authenticated to confirm that over 95% of those contain FORGED source of funds documents. Had Mayorkas NOT intervened, neither GCFM nor SLS Casinos would have received approval for even a single EB-5 visa petition.

The funny thing is, Whalen WILL be proven wrong shortly enough because even before SSA Johnson testified in front of the senate, as rumour has it that the DHS already initiated an audit of EVERY single EB-5 visa petition filed by SLS and GCFM, and it is believed that every one of them will be rescinded shortly.

Potential changes to S. 1501 may end up causing regional centers to completely leave the EB-5 visa program.

As it is, S. 1501 seems to have been heavily influenced by the major regional centers in order to force the smaller regional centers out of the EB-5 visa program and capture their market share.

S. 1501 has already proposed 2 important changes to the EB-5 visa program, which include an increased investment amount, restricting loans to  bank loans only and restrictions on TEA locations going forth.

However, there may be a few more amendments coming forward to S. 1501, and they are:

  1. Requirement that Regional centers comply with securities laws in the US AND abroad, as regional centers usually market and sell their securities abroad.
  2. Requirement of authenticated documents such as tax returns, bank records, loan agreements etc. to prove lawful source of funds.
  3. Restrictions on the current practice of regional centers hiring employees for only a few days and then firing them after the "evidence" of job creation is sent to the USCIS.
  4. Restricting TEA definitions to single census tracts for future EB-5 visa investments in even those regional centers where TEA definitions have been gerrymandered.
  5. Potential elimination of 'indirect job' counting.
In case these proposed amendments ARE included in S. 1501 before it is passed and signed into law, the regional center industry will anyway collapse as it will not only eliminate the money laundering and securities law violations, it will also require genuine employment creation and stop the gerrymandering in TEA definitions.

Will S. 1501 cause most regional centers to be kicked out of the EB-5 visa program?

It looks like Senator Grassley and DHS Chief Jeh Johnson are having a good laugh over the dog and pony show they've put up. First Jeh Johnson wrote to Senator Leahy and Senator Grassley in April 2015 to make changes to the EB-5 visa program, and then these same senators introduce a bill (see link at https://www.govtrack.us/congress/bills/114/s1501/text) purportedly incorporating these changes, to "renew" the same regional center program with a few major headaches for the smaller regional centers. It basically looks like the bigger regional centers are trying to use legislative influence to kick out the smaller regional centers.
 The problem is, many in the law enforcement community oppose this bill as it does not do much to prevent the money laundering and illegal offering and sales of regional center securities overseas, and is just favouring the larger regional centers over the smaller ones, which will probably lead to serious infighting in the IIUSA (which is the regional center trade association). 
As predicted for the past few months, HR 616 is all but dead as Congressman Jared Polis failed TWICE in a row to get Congressional approval to extend the regional center program, due to which the major regional centers are now using Senators to get approval to extend regional centers in the EB-5 visa program and simultaneously squeeze out the smaller programs. The question that now faces regional centers (with less than 4 months to go) is whether they will come up with enough Senators who're foolish enough to vote against the wishes of hundreds of investigators from over a dozen federal law enforcement agencies.
The only obvious beneficiaries are EB-5 visa investors who choose to invest in Direct Investment Businesses. What is the shocking secret about EB-5 visas that regional centers don't disclose? Where are the missing I-829 approvals?

Regional centers and many "due diligence experts" don't disclose the shocking truth that over a hundred 100 EB-5 visa investors who got their I-526 approvals have been ordered deported due to a failure to get their I-829 approval, and thousands of EB-5 visa investors are now facing deportation (removal) as regional centers are unable to help them get their I-829 approval. The imminent release of the GAO audit will increase pressure on the USCIS to commence removal proceedings against EB-5 visa investors who've been unable to get I-829 approval.

This can be easily verified by filing a FOIA request with the USCIS or comparing the number of I-526 approvals for a year, and then seeing the number of I-829 petitions and approvals for 2 years down the line. EB-5 visa investors should know that they only get a conditional green card for the first 2 years and this green card status expires if the EB-5 visa investor isn't able to prove within 2 years that the EB-5 visa investor (or the petitioning regional center) has created the 10 jobs. To remove the conditional status, the EB-5 visa investor has to file the form I-829, and only if the EB-5 visa investor is able to prove compliance with the conditions of the EB-5 visa program (investing the $500,000 and creating 10 jobs), is the investor granted unconditional Permanent Resident Status. If an EB-5 visa investor is unable to prove compliance with the conditions, the EB-5 visa investor loses their LPR status and becomes an illegal alien.

EB-5 visa investors should ask ALL EB-5 service providers who wish to provide advice or services to EB-5 visa investors, the following important questions and insist on getting the answers in writing in order to quickly weed out the frauds and crooks:

1) Will you be owing me a fiduciary duty if I signed up with you? If the answer is NO, then avoid them.
