IIUSA (the trade body for regional centers) and Greenberg Traurig are desperately trying to save the regional center program from being shut down!

Crooks are like Opium Addicts, they always need their fix of OPM (Other People's Money). I've learnt that Greenberg Traurig (which by some accounts is said to be the lobbying firm with the sleaziest clients in D.C.) is now trying to use gay Democrat Congressman Jared Polis (don't birds of a feather flock together?) and a few other similarly ethically challenged Congressmen to protect regional centers from being permanently shut down next year. The problem is, the folks at GT seem to be unaware that come November, we will have a vastly reshaped House and Senate that will be filled with Republicans out to sabotage Hillary's presidential campaign for 2016, and the easiest way to do it is by prosecuting cases of fraud and abuse of process in regional centers such as GCFM and SLS casinos. As it is, not only ICE, now the entire DHS is up in arms against regional centers after Alejandro Mayorkas (probably the MOST CORRUPT man in the entire DHS) has repeatedly violated the laws and helped regional centers get EB-5 visas illegally and fraudulently, and right now, the odds of Polis getting unseated are quite high due to his picking up fights with the Energy industry in CO. Moreover, even practically speaking, measures are being implemented to make it impossible for regional centers to carry on with their fraud and conflict anymore, and in practical terms, the by-product of those steps will be the natural death of regional centers.

What regional center owners still don't seem to understand is that the days of ignorance are GONE, and today EB-5 visa investors prefer Direct Investment Businesses and avoid regional centers due to the 20 month wait and 1% annual return with almost certain capital loss, terrible exit strategies and rampant fraud and conflict of interest that is seen in pretty much every single regional center. I don't think even a single regional center CEO can honestly state that they have not violated or attempted to violate securities laws, and I also don't believe that we can find even 1 regional center where fraud and conflict of interest do not exist. Some of the  ways these so-called experts seem to be negligent (and potentially liable for damages too) are:

1) They failed to advise EB-5 visa seekers that regional centers were illegally offering and selling securities overseas.

First Sbarro threw in the towel, and now Quiznos got toasted. This is WHY I tell EB-5 visa investors to avoid investing in risky franchises such as Twistee Treats, Voodoo BBQ, Marcos Pizza, etc.

A few days ago, I wrote about the dangers of investing in risky franchises, and today I saw yet another example of a risky franchise going bankrupt. That is right, Quiznos got toasted.
What can EB-5 visa investors learn from these examples?

The first lesson is, do NOT trust someone who doesn't ow you a fiduciary duty. A licensed Business Broker (who also holds a RE Broker License) or an Attorney or CPA representing only the EB-5 visa investor can be trusted as their only loyalty lies with their client. A sleazy marketer such as Chaim Katzap or Kevin Jeffers or Joe Sloboda and Fred Burgess as well as other similar individuals who've illegally marketed and sold regional center securities are NOT to be trusted at all, as their track record shows they've caused enough EB-5 visa investors to lose time and money.

Are Regional Centers committing securities fraud by failing to disclose that seeking EB-5 visa through regional centers is literally a waste of time? What is the safest & fastest way to get EB-5 visa?

In the US, concealing material facts while offering securities is classified as the crime of securities fraud. Andrew Shepin is so worried about me warning EB-5 visa investors about fraud that he even asked a misleading question: is it possible to advise investors without a securities or financial advisor license.

Apparently Mr. Shepin does not realise that Business Brokers are definitely permitted to advise their clients, and I actually owe a fiduciary duty to my clients to advise them about fraud. As for my blogs where I warn EB-5 visa investors about deceitful and dishonest individuals and firms who try to cheat or mislead EB-5 visa investors, I can't help it if Mr. Shepin or other fraud supporters are distressed every time I name and shame deceitful individuals in public. The only reason I've NEVER been sued by those I publicly named and shamed (such as Serge Bauer, David Tashroudian, Anthony Rodham, Matt Gordon, Brian Su, Harry Reed, Alejandro Mayorkas, etc.) is simply because I don't make false allegations, and people I name and shame, know I can prove my statements quite easily and VERY embarrassingly. Several folks made blustering threats to sue me, but their bravado disappeared when they realised that I can and will expose them easily in court.

Mr. Shepin, your question is VERY misleading and the right question is: Are regional centers and their affiliates actually defrauding or attempting to defraud EB-5 visa investors? I know that my articles are harming the business of those who cheat, but it is better that crooks get exposed than EB-5 visa investors get cheated.

I just wish to tell you that there is a reason I have zero respect for those who try to mislead others. The internet is a very potent tool, and I know exactly what prompts your question. All I will say is, there is a difference between advising EB-5 visa investors, and promoting the advantages of my services in comparison those who wish to make a living cheating others. There is a difference between merely advising EB-5 investors and warning them about deceitful and dishonest individuals. When you learn to ask the right question, you will get the right answer. When you ask misleading questions, you simply expose yourself as someone who is not to be trusted. If you, like those who support fraud, believe my writings are illegal, feel free to report me. I am sure you will realise that it is not a crime to report crime or expose criminals, and you will only face failure in your exercise in futility.

It is sad to see that instead of supporting transparency and accountability, Mr. Shepin seems to be more interested in implying that I am advising investors, when all I do is warn them, and advertise the superiority of my business advisory services over those of my dishonest and deceitful competitors. The only time I actually advise is when someone is my paid client. Till then, I let people form their own conclusions. AFAIK, I don't believe I need a securities license to advise anyone about potentially fraudulent transactions, and if folks such as Andrew Shepin find it distressing that my writings warn EB-5 visa investors about how to avoid fraud and WHO to avoid, then they can go on to write to regulators about my actions. As it is SEC already had a black eye when another fellow CFE (Certified Fraud Examiner) warned them in vain about Madoff's fraud for years, and Mr. Shepin and his regional center supporters will simply discover that this time around, the SEC wasn't so slow to react to a CFE's warnings, and actually has investigations against several of the folks I've named and shamed. I take pride in helping warn unsuspecting people from fraud, and if you feel my actions are illegal or unethical, feel free to write to the regulators. Every single day, people thank me for exposing fraud, and those who feel bad that I warn others about fraud can go sulk in a corner.

Why are SEC, FBI, DHS OIG, ICE and USCIS are acting against regional centers? Why has ICE actually recommended shutting down regional centers? Why are senators and congressmen investigating regional centers. The reason is simple: Regional centers usually engage in fraud and violate securities, AML and tax laws.

Looks like several regional center sponsored projects will be the subject of congressional and criminal investigations, while EB-5 visa investors' funds and applications are doomed to be stuck in limbo!


I just read an article released by a Greenberg Traurig attorney who seems to be warning regional centers about a new Congressional Investigation by Senator Coburn, who is now targeting several regional centers.

For those who're unaware, Greenberg Traurig is the SAME law firm that was notorious for the Jack Abramoff scandal, and any Beltway insider can tell you about their reputation. Usually regional centers who've worked with Greenberg Traurig seem to have a rather undesirable track record when it comes to delivering results to EB-5 visa investors. EB-5 visa investors should remember that any entity dealing with Greenberg Traurig should be scrutinised VERY carefully, as the chances of fraud may be exponentially higher with them involved, as they seem to be giving out alerts every so often to folks looking involved in defrauding EB-5 visa investors.

This new investigation follows another scandal which was reported in an article online (see link http://www.washingtontimes.com/news/2014/jan/22/editorial-harry-reids-casino-luck/ ) about Harry Reid and Alejandro Mayorkas helping a regional center raise funds illegally.

Question is: WHY are Senators Grassley and Coburn (see http://www.cis.org/north/sen-coburn-asks-eb-5-questions-uscis-should-be-asking)  targeting regional centers who're defrauding EB-5 visa investors?

In short, the answer seems to be political payback, where the real targets are Senator Harry Reid as well as Democratic Presidential Contender Hillary Clinton. Of course, the action can't be seen to be targeted as part of a political vendetta, so a few other major crooks will be targeted too. As it is, when Harry Reid's name is linked to a casino where it is not very hard to find several securities law violations and immigration law violations, and the link is Harry Reid's son (who happens to be a lobbyist for Nazarian), it does not take a genius to get criminal convictions. When the conduit seems to be a dirty former prosecutor who now sits near the very top of DHS (just search online for "Alejandro Mayorkas + Vignali + cocaine + pardon"), it does not take long to get indictments. In the case of Hillary Clinton's kid brother, it is actually a whole lot easier to find securities fraud, money laundering AND securities law violations, and I believe the indictments will be timed just right for the 2016 presidential election campaign, and it will probably yield convictions of Terry McAuliffe, Anthony Rodham and some other notable names as well as a female African American attorney.

What is the safest way to get an EB-5 visa?

It is quite common for EB-5 visa seekers to encounter unethical and unscrupulous crooks who use a wide variety of marketing gimmicks and fancy sales presentations to defraud EB-5 visa investors. Regional Center owners such as Serge Bauer try to lie to, scare and confuse EB-5 visa investors in order to cheat them.

Has Serge Bauer of Maryland Regional Center actively defrauded EB-5 visa investors?

In 2012, Serge Bauer was directly asked " As a Regional Center attorney, are you willing to personally provide a sworn notarised affidavit made under the penalty of perjury that your regional center is free of fraud and conflict of interest, and discloses all material information to investors and also complies with securities / tax / foreign exchange laws governing the regional center's conduct in the US and abroad?" and he simply refused to do so, so I am sure we can all safely assume that he himself is was engaging in fraud too. (Mr. Bauer wrote on the 1st of February 2013, and claimed that "we have not accepted  subscribed any EB-5 investors nor accepted any deposits from any EB-5 investors." In that case, I stand corrected about the tense, as it may be more appropriate to use the past tense instead of the present tense. My doubts about Mr. Serge Bauer's ethics and the legality of his actions remain unchanged though. My questions for Mr. Serge Bauer at this point are:
  1. Have you EVER attempted to illegally offer and / or sell securities to EB-5 visa investors, or otherwise help violate securities law violations or help those that did?
  2. Did you EVER fail to disclose material facts to potential EB-5 visa investors?
  3. Do you realise that during discovery, I will be subjecting you to the most invasive forensic audit, interrogatories, subpoenas and depositions you've ever seen to prove that you may have actually aided and abetted those who commit securities fraud, and may also have participated in a conspiracy to commit securities fraud and committed securities fraud, securities law violations and other felonies? This includes you as an attorney AND your regional center too, which means I will be going over your books and past communications, speaking with every single one of your clients to discover whether you speak the truth. Mr. Bauer doesn't realise that speaking the truth IS an affirmative defense and if I can uncover just how Anthony Rodham and Terry McAuliffe violated securities laws, committed securities fraud and laundered money, and also uncovered the conflict of interest by David Tashroudian and Joe Sloboda, as well as the shenanigans of Harry Reid & Sam Nazarian, he is incapable of hiding the truth from me, and I can easily expose him too. I don't do too many forensic audits nowadays, but I can go through discovery to expose him in a spectacular fashion, and speaking the truth has always been an affirmative defense.)

My dear Mr. Lundy

I saw some of your comments on Serge Bauer's LinkedIn Forum, "EB5 visa group". I know that for a living, you aid and abet regional centers that are most likely committing securities fraud and securities law violations, and it is entirely your choice on how to earn your living. What you don't know is, I have been blocked by Serge Bauer from posting on his forum as the truth actually hurts his business while it helps boost my business. A well informed EB-5 visa investor is actually my best customer, while a well informed investor is a regional center owner's worst nightmare.

If you actually have a spine, why don't you and Jeff Wagner join my forum 'EB-5 visa - Direct Investment Business' and see if you can win a debate with me online. It is very easy for unethical folks who aid and abet crooks for a living to take potshots when they know I'm blocked from giving a fitting reply, but if you do happen to grow a spine, feel free to join me on a forum where we can debate. FYI, failure to disclose material facts IS securities fraud.

By the way, even when Serge Bauer was directly asked " As a Regional Center attorney, are you willing to personally provide a sworn notarised affidavit made under the penalty of perjury that your regional center is free of fraud and conflict of interest, and discloses all material information to investors and also complies with securities / tax / foreign exchange laws governing the regional center's conduct in the US and abroad?" and he simply refused to do so, so I am sure we can all safely assume that he himself is engaging in fraud too. 


The only inaccurate statement I'd made was about a moratorium, when it actually was an unofficial delay based on a go slow approach adopted by USCIS officers who were appalled at the widespread fraud commmitted by regional centers. The mistake was based on an inaccurate statement that was relayed to me, and I will definitely accept that there was no moratorium, just a massive delay which we see till this date for regional center filed EB-5 visa petitions, as multiple agencies are collectively scrutinising the I-526 petitions filed by regional centers.

EB-5 visa outlook and predictions for 2014 and 2015. Important facts for EB-5 visa investors to consider.

Here are my predictions for EB-5 visa investors for 2014 and 2015.

  1. ICE's recommendation to shut down regional centers will be taken seriously and most if not all regional centers will be shut down by end of 2015.
  2. Hundreds of EB-5 visa investors who failed to get their I-829 approved and are now out of status will be deported, resulting in massive lawsuits against regional centers as well as folks such as Brian Su, Thom Casebolt, Tyler McKay, Kevin Jeffers, Fred Burgess, Joe Sloboda and others who aided and abetted regional centers in committing massive securities fraud.
  3. USCIS, SEC, IRS, FBI and ICE will issue several new regulations and increase regulatory oversight, resulting in further delays of regional center sponsored I-526 petitions from 18 months to 26 months.
  4. Increased regulatory and compliance requirements will cause massive denials of regional center filed I-526 petitions for EB-5 visas due to securities law and fraud issues as regional centers
  5. Number of Targeted Employment Areas (TEA) will sharply decrease due to improving labour market and sharp drop in unemployment numbers.
  6. Chinese EB-5 visa Investors will see significant delay due to pending visa petitions.
  7. Most EB-5 visa investors will refuse to deal with regional centers and ask for Direct Investment due to better returns and lower risk.
EB-5 visa investors should ask ALL EB-5 service providers who wish to provide advice or services to EB-5 visa investors, the following important questions and insist on getting the answers in writing in order to quickly weed out the frauds and crooks:

1) Will you be owing me a fiduciary duty if I signed up with you? If the answer is NO, then avoid them.

2) How many years of experience do you actually have with Direct Investments and how many EB-5 visa investors have you actually helped under the Direct Investment Category?

3) In the past, have you sold or marketed regional center securities to EB-5 visa investors? If the answer is YES, please avoid that individual, as it is quite likely that they have committed securities fraud and money laundering.

4) Are you willing to offer a written guarantee of full disclosure of material facts and freedom from conflict of interest?

5) Are you willing to offer a fee refund guarantee in case my case is denied due to your negligence or incompetence?

If a service provider or marketer will not owe you a fiduciary duty, then do NOT trust them at all.
